KIDNEYUP ONLINE STORE TERMS AND CONDITIONS

I. Definitions

  1. Store – online store operated at the website address www.kidneyup.pl
  2. Seller – KidneyUp limited liability company, KRS 0000962805, NIP 7393965990, REGON 521570582 Registered office address: Pułkownika Stanisława Dąbka 140 / 2-3, 82-300 Elbląg, Poland
  3. Customer – a natural person, legal entity, or organizational unit with legal capacity that uses the Store.
  4. Consumer – A customer who is a natural person making a purchase not directly related to their business or professional activity.
  5. Terms and Conditions – these terms and conditions
  6. Product – goods or digital content offered in the Store
  7. Sales agreement – a sales agreement concluded between the Seller and the Customer remotely.
  8. Order – a declaration of intent by the Customer to conclude a Sales Agreement
  9. Customer Account – individual customer panel available after registration
  10. Working days – days from Monday to Friday, excluding public holidays

II. General provisions

  1. The Terms and Conditions define the rules for using the Store and the terms and conditions for concluding Sales Agreements.
  2. The Terms and Conditions constitute terms and conditions within the meaning of Article 8 of the Act on the provision of electronic services.
  3. The Terms and Conditions are available free of charge on the Store's website and may be saved by the Customer.
  4. The store sells its products in the territory of the Republic of Poland and, if indicated, other EU countries.
  5. To use the Store, you need a device with Internet access and an up-to-date web browser.

III. Terms of Use and Registration

  1. Customer Account registration is voluntary.
  2. Orders can also be placed without registration.
  3. The customer is obliged to provide truthful information.
  4. It is prohibited to provide content that is unlawful or infringes the rights of third parties.
  5. The Seller may suspend the Customer's Account in the event of a gross violation of the Terms and Conditions or a violation of the law.

IV. Placing orders and concluding the contract

  1. Orders are placed using the order form available in the Store.
  2. Adding a product to your shopping cart does not constitute a contract.
  3. The sales agreement is concluded upon confirmation of the order by the Seller via email and payment for the order by the Customer.
  4. Agreements are concluded in Polish.
  5. After the Customer has provided the necessary data, a summary of the Order will be displayed, which will include, among other things, a description of the selected goods or services, the total price, and other costs.
  6. In order to send an Order, it is necessary to accept the Terms and Conditions, provide the personal data marked as mandatory, and press the button confirming the Order.
  7. Information about Goods provided on the Store's websites constitutes an offer within the meaning of Article 66 of the Civil Code.
  8. By placing an Order, the Customer declares their intention to conclude a sales agreement in accordance with the Terms and Conditions.
  9. After concluding the contract, the Customer receives an e-mail containing confirmation of all essential elements of the Order.

V. Prices and payment methods

  1. All prices are quoted in Polish zlotys and are gross prices.
  2. The store offers the following payment methods:
    • fast online payments
    • others indicated in the Store.
  3. Payment must be made before the order is processed, unless otherwise specified.

VI. Delivery

  1. Delivery is carried out by courier companies or parcel locker operators to the address provided in the order.
  2. Delivery time is 1 to 5 business days plus delivery time by courier service.
  3. Delivery costs are indicated when placing the order.
  4. The risk of loss or damage to the Product passes to the Consumer upon delivery.

VII. Right to withdraw from the contract

  1. The consumer has the right to withdraw from the contract within 14 days without giving any reason.
  2. The term runs from the date of taking possession of the Product.
  3. To exercise the right of withdrawal, the Consumer shall submit an unequivocal statement.
  4. Refunds will be made within 14 days.
  5. The consumer bears the direct costs of returning the Product.
  6. The right of withdrawal does not apply, among others, in the following cases:
    • hygiene products after opening,
    • digital content after the start of its provision.
    • To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by sending an unambiguous statement by email to: sklep@kidneyup.com, or use the withdrawal form template available on the Store's website.

VIII. Complaints (warranty)

  1. The seller is liable to the consumer under the warranty.
  2. Complaints can be submitted:
    • in writing,
    • by email to the Store's email address sklep@kidneyup.com
  3. The seller will respond to the complaint within 14 days.

IX. Warranties

  1. Products may be covered by the manufacturer's warranty.
  2. The warranty does not exclude rights under the warranty.

X. Electronic services

  1. The store provides free electronic services, in particular:
    • maintaining a Customer Account,
    • contact form,
    • newsletter (with separate consent).
  2. The customer may opt out of electronic services at any time.

XI. Protection of personal data

  1. The Seller is the administrator of personal data.
  2. Data is processed in accordance with the GDPR.
  3. Detailed rules are set out in the Privacy Policy available in the Store.

XII. Out-of-court dispute resolution

  1. Consumers have the right to use out-of-court dispute resolution methods.
  2. The European Commission's ODR platform is available.

XIII. Final provisions

  1. The applicable law is Polish law.
  2. In matters not covered herein, the provisions of generally applicable law shall apply.
  3. The Terms and Conditions are effective from the date of publication in the Store.
